Terms of Service

1-General
1.1 - By commissioning me you agree to this terms of service.
1.2 - This terms are relevant for non-commercial commissions only. For commercial projects an agreement will be discussed directly with the client.
1.3 - I reserve the right to alter these conditions. New changes won’t affect clients who have agreed upon previous terms.
1.4 - I have the right to refuse a commission I am not 100% comfortable with.
1.5 - I have the right to cancel a commission if the payment haven't been made or haven't come through paypal.2-Payment
2.1 - Payment will be done via PayPal, Stripe (credit card) or bank transfer/Pix (for brazilians). For my own security I will not start working before I’ve received full payment or 50% of the value ahead for big commissions (over $200). Agreement will be made via email with the client.
2.2 - Please, I ask you to wait for my signal to pay me, do not rush in and send a payment to my paypal without an invoice. I’ll notify you a few days before I scheduled your commission to be done and send you an invoice.
2.3 - Due Paypal's policy in my country, I DO NOT offer refunds. Be sure you want my art or adopt when you commission me.
2.4 - Payments for YCH’s must be done within 24H of the auction’s end. In case the payment is not received I reserve the right to sell it to the previous higher bidder.3-Workflow and Revisions
3.1 - I’ll finish commission in the same order I’ve received them. However in some occasions I may alter it due creative purposes and time management. Putting a headshot slot in front of a big scene slot, for example.
3.2 - I reserve the right to keep rejected sketches and drafts, modify and use them as I see fit. The client may request to keep some for future commission, in which case I'll do holds for 3 months or to purchase the sketch and an extra.
3.3 - Unless the commission is about a sketch or a wing-it piece, I will always send sketch first and wait for approval. Turn around time might change depending on the time the client takes to reply. I am not responsible for eventual delays generated by late answers from my clients.
3.4 - The client may request wip shots of their commissioned image whenever they want it, they will always be sent via email and/or instant messengers (Discord, Telegram or Meta Messenger).
3.5 - I will accept adjustments to you commission as long as they are in sketch, linework and flat color stages (each adjustment on said stage. I won't alter the pose while working on flat colos, for example). Past these stages, I’ll charge a extra fee for adjustments. I expect my clients to be reasonable in this aspect.
3.6 - In case the commission is a sketch I’ll accept changes before the sketch is refined. I'll send a WIP to be sure I did the character right.
3.7 - After the illustration is done I reserve a 3 days time for the client to answer me back in case there was something amiss in the art that somehow escaped our notices. I won't adjust color, pose or composition, but minor details such as scars, jewelry, beauty marks, etc.4-Image Rights
4.1 - I retain all the rights of my artwork. This entail the right to use, publish, repost, alter (size and color management) and sell prints of the artwork.
4.2 - The client retain right to repost their commissioned art without my written permission as long as my signature is visible.
4.3 - My clients have the right to use the full resolution image for any non-commercial, no-profit purposes such as printing for personal use, crop the image to serve as icons, banners, etc. without my written permission.
4.4 - Commercial use of the commission might be bought for an additional fee. If that’s the case, this will be discussed in private via email.
4.5 - The rights of the characters commissioned are kept to their respective owners.5-Deadline and Updates
5.1 - Unless previously stated, I will finish the drawing accordingly to my queue.
5.2 - I strive not to take more than two months to finish a big project.
5.3 - Clients may set a deadline for their commission, but an extra fee might be charged accordingly to the amount of time and complexity of the project.
5.4 - I have the right to give priority to commissions with deadlines. The same is valid for commercial works.6- Artist's Notes
6.1 - I am an adult freelancer. I expect my clients to treat me as such as I’ll treat them as an equal.
6.2 - I won’t draw what I think it’s offensive, but I won’t judge my clients about their beliefs and preferences, nor make it public in any way.
6.3 - You must be over 18 years old to commission me for adult art.If there is anything unclear or in case I didn’t cover any aspect you are uncertain about, feel free to send an email to [email protected] and I’ll answer it as soon as possible.
